Expungement of Record
What Is Expungement of Record?
Legally, expungement means that a criminal record is destroyed, or sealed from state or federal records.
It means that a court must treat the criminal incident as if it had never happened—removing it from a defendant’s criminal record, and the public record.
Why Is Expungement of Record Important to You?
If you’re found not guilty of a criminal offense, or the case is dismissed, you’ll want to make sure that charge doesn’t remain attached to you as part of a criminal record.
Even if an incident doesn’t result in a charge, the arrest report or incident report can remain on your record. We'll remove it for you.
What does Firearms Legal Protection do to help?
Firearms Legal Protection will fight to expunge records remaining from a Firearms Legal Protection covered incident (not resulting in a conviction) by funding attorney fees up to $5,000 to ensure you keep a clean record.
Expungement of Record
Expungement of a record can be complex, so we aim to simplify it. When a member acts in lawful self-defense and proves in court that their actions were justified, the arrest record can still appear in background checks, potentially affecting job, housing, or insurance applications. Expungement is the legal process of removing such records. If a member wins their case or has charges dropped, Firearms Legal Protection will cover the cost of an attorney to help expunge or clear those records, ensuring they don’t appear in future background checks. Please note, this benefit applies only to covered self-defense incidents, not prior arrests or other matters before membership.
